Uzbekistan`s notary system to undergo reform

The President of Uzbekistan signed a Law on radical reforms in the notary system, the press service of the Senate of the Oliy Majlis said. The document was adopted by the Legislative Chamber on December 9 and approved by the Upper House of Parliament on December 14 and entered into force after being signed by the Head of State on January 15.

The law introduced amendments and additions to the laws "On pledge", "On notary", "On leasing", "On mortgage", "On real estate activity", "On exchange of credit information", "On guardianship", "On mediation", Civil and Civil procedure codes, as well as the list of activities that require licenses.

The document provides for:

- step-by-step transfer of state notary offices to non-state notary offices;

- procedure for organizing the activities of the Notary chamber of Uzbekistan, its main tasks and activities;

- abolition of mandatory notarial certification for certain types of transactions, as well as the introduction of new types of notarial actions;

- cancellation of certain requirements for certification of contracts of alienation, lease and gratuitous use of property and simplification of the process of certification of such transactions;

- introduction of a mechanism for remote notary actions, including via video conferencing;

- insurance of civil liability of notaries of non-state notary offices to protect citizens from damage caused during the performance of their professional duties by a notary;

- provision of operational notary services by improving the system of electronic access to the notary.
